1. Nature of the Service and Dashboard Access

mybusinesscard.digital is provided entirely free of charge as an independent, personal project. There are no premium tiers or hidden subscriptions. Users can freely access the dashboard as a "Guest" to test the creation tool. However, all data and images entered by Guests are temporary and are automatically and permanently deleted every 24 hours via automated server tasks (cronjobs) unless the user completes the free registration. The Administrator reserves the right to modify, suspend, or terminate the service, or any part thereof, at any time, for any reason, and without prior notice or liability to any user.

2. Absolute Limitation of Liability (Disclaimer)

To the maximum extent permitted by applicable law, the service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. The Administrator operates as a private individual and does not guarantee that the service will be uninterrupted, secure, error-free, or permanent. Under no circumstances shall the Administrator be liable for any direct, indirect, incidental, special, consequential, or exemplary damages—including but not limited to loss of profits, data loss, business interruption, or reputational damage—arising out of or in connection with your use or inability to use the service.

3. User Content, Automated Moderation & Full Indemnification

Users retain sole legal, civil, and criminal responsibility for all data, text, external links, phone numbers, and media uploaded to their digital business cards. It is strictly forbidden to use this platform to host, share, or link to illegal, fraudulent, defamatory, adult, or malicious content (including phishing and malware). The platform utilizes automated moderation tools and third-party APIs to scan text and links. The Administrator reserves the right to automatically flag, suspend, or delete any content or account that triggers these security filters or receives user abuse reports, without prior notice. By using this service, you agree to fully indemnify, defend, and hold harmless the Administrator from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising from the content you publish or your violation of these Terms.

4. Intellectual Property & Platform Transfer of Ownership

All software code, architecture, graphics, and templates provided belong exclusively to mybusinesscard.digital. The Administrator retains the absolute right to sell, assign, license, or transfer the entire platform, its brand, technological infrastructure, and the complete bundle of related digital assets (including the registered user database) to any third-party entity at any time, without requiring further consent from the users, in order to ensure uninterrupted service delivery. The acquiring party will assume the rights and obligations of these Terms. If a user does not agree to the transfer of the service to the new owner/operator, their sole and exclusive remedy is to permanently delete their account and data via the dashboard features before the transfer takes place.

5. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Italy.

3. Data Storage, Hosting and Infrastructure

All data is processed within the EU. Personal data is stored on servers of Netsons S.r.l. in Italy. Media files are hosted on Cloudflare R2, ensuring 100% GDPR compliant residency within the EU. [1.1]

4. Property Transfers and Continuity of Service

Your data is not sold or shared for marketing. However, in the event of a merger, sale, or transfer of the project, user data will be legally transferred to the new owner to ensure service continuity. [1.1]
